The Four Types of Traumatic Brain Injuries

A traumatic brain injury can lead to a multitude of problems, some of which might be lifelong. Almost everything from movement to personality can change with a single brain injury. Complications that arise and the length of those complications depend on the type of brain injury someone suffers. If your brain injury was caused by someone else’s negligence, consider asking a Jackson brain injury lawyer about your options for compensation.

Types of Traumatic Brain Injuries

The four main types of traumatic brain injuries are broken down by severity level:

  • Mild traumatic brain injury
  • Moderate traumatic brain injury
  • Severe traumatic brain injury
  • Penetrating traumatic brain injury

Mild traumatic brain injuries can also be thought of as concussions, the least severe form of a brain injury. People with these injuries only pass out for 30 minutes or less and regain their functioning by the end of the day. There might be some initial confusion about who or where they are and what happened. Memory might be impaired for a short while but is regained sooner than later.

What Are the 4 Types of Traumatic Brain Injuries?

Moderate traumatic brain injuries often involve someone passing out for longer than 30 minutes. The symptoms of confusion and memory loss tend to last longer than a day. Some functions might be impaired but not major functions like being able to move or speak.

Severe traumatic brain injuries involve passing out and various impairments that last several days. Some impairments can be lifelong with speech, personality, sleep, movement, and the five senses being affected in different ways. Someone with a severe brain injury may slur their words, not be able to walk, have blurry vision, or fall into a coma.

Penetrating traumatic brain injuries happen when the skull and scalp are cut open, exposing the brain to the outside world. This can happen with severe head trauma or sharp objects puncturing the skull. The chances of infection are high while the chances of survival are low.

Primary Versus Secondary Brain Injuries

There are also primary brain injuries and secondary brain injuries. These vary in terms of how the damage occurs and when the brain damage stops. Brain damage caused by primary brain injuries is complete at the moment the injury occurs. This means no more brain damage is likely to happen after the initial damage.

Secondary brain injuries involve brain damage that continues to worsen after the initial injury. Hours or days of continuing brain damage can happen due to:

  • Brain swelling or inflammation
  • Changing chemical, tissue, and cellular portions in the brain
  • Brain infections

Do not hesitate to contact a Jackson brain injury lawyer if your injury was caused by someone else. Depending on the severity of your brain injury, you could be eligible for additional compensation.

Vicksburg, MS (August 28, 2022) - On Friday, August 26th, a two-car accident in the area of Clay Street and Highway 27 caused injuries and serious delays in the already heavy traffic heading to the Red Carpet Bowl.

Reports show that multiple injuries were caused by the incident, the nature and degree of which remain unreported.

Vehicle Accidents in Mississippi

Vicksburg, MS - Injuries Prompted by Vehicle Crash at Hwy 27 and Clay St

When a traffic collision takes place, the potential for bodily harm, emotional anguish, and property damage are present. Hopefully, the driver responsible has enough insurance coverage, and you can file a claim that will cover all of your losses.

As is so often the case, the insurer’s payout may not be enough to cover all of your damages. This is particularly true if you were in a violent collision that left you with painful or permanent injuries and unable to work. When this happens, you are able to file a suit against the liable driver or their insurance company to try to recover any additional losses.

While bringing a suit is always an option, not all cases end successfully. To create the most compelling case possible and increase your odds of winning, you and your Mississippi personal injury attorney will need to show that:

  • The respondent owed you a duty of care
  • The respondent violated that duty by their actions
  • These actions were the cause of your accident
  • The accident led to your damages

If you sustained damages caused by the negligence of another driver, then we strongly urge you to allow a respected personal injury lawyer to evaluate your claim. Contact our personal injury attorneys in Mississippi at (601) 487-0555 to schedule an appointment.

Passenger Rights in a Mississippi Car Accidents

Jones Co, MS - Three Injured in Single-Vehicle Crash on Houston Rd

When it comes to Mississippi car accidents, passengers are in an unusual position  An injured passenger is seldom accountable for the incident but is just as likely to be injured as the driver who caused it.

Car insurance coverage is required for all drivers statewide. In the event that a passenger is injured during an accident, the driver’s policy will be used to compensate the injured passenger for their damages.

Usually, filing a claim against an insurance provider results in nothing more than a low settlement offer that won’t even cover the victim’s basic medical costs. Anytime an insurance company representative makes you an offer, you should speak with an experienced personal injury attorney in Mississippi before you accept it.

If you experienced serious injuries caused by the recklessness, negligence, or malfeasance of another person, we are here to review your potential personal injury claim. Contact our personal injury attorneys in Mississippi by calling our law offices at (601) 487-0555 to schedule a case evaluation.

A free consultation with a passenger injury lawyer from Germany Law Firm, PLLC can provide you with a full understanding of the nuances of your claim, what medical bills to expect now and in the future, and the estimated value of your claim before you consent to a devalued settlement offer.

Treatment Options for Post-Traumatic Stress Disorder

Post-traumatic stress disorder is a condition that develops when a person is exposed to terrifying and highly disturbing events that affect their mental health. A person can suffer from PTSD when they experience a shocking event or even just by witnessing one. If left untreated, PTSD can manifest in many harmful ways that can take a toll on a person and can even cause them to engage in very unhealthy habits like drug or alcohol use.

Violent events, war, fires, car accidents, and many other incidents can lead to PTSD. When an incident takes place where one party’s negligence is the reason why another suffered physical and mental harm like PTSD, it may be possible to obtain compensation for all of the damages that resulted. In Mississippi, the Jackson car accident attorney at The Germany Law Firm, PLLC can talk with you about what legal methods are available to get the compensation you need after a traumatic event.

How is PTSD Treated?

Treatment Options for Post-Traumatic Stress DisorderThere are treatment options for PTSD that are promising and that may be able to give a person back their life. Most commonly, psychotherapy is the primary tool used to help patients manage their PTSD. In some cases, medication may also be advantageous.

Psychotherapy can consist of cognitive, exposure, and eye movement desensitization and reprocessing therapies. Cognitive therapy can address unhealthy thinking patterns and work to change them to be more constructive. Exposure therapy puts you directly in front of the trauma you experienced that caused your PTSD and helps you confront it. Eye movement desensitization and reprocessing therapy use exposure therapy with eye movement patterns that combined, are meant to help you better process and respond to your bad memories.

In addition to these therapies, a medical provider can assist you with stress management. This is necessary to improve your ability to cope with other upsetting situations in life that you may experience.

Sometimes it is beneficial to speak to a therapist one-on-one. In other instances, attending therapy in a group setting is the right way to treat a patient.

Medications may also be useful. Antidepressants can soothe and minimize depression and anxiety while also promoting better sleep patterns and alertness. Anti-anxiety medications can reduce feelings of uneasiness. These medications typically are not used in the long term. In addition, some studies have shown that Prazosin could help PTSD sufferers manage their nightmares.

The treatment plan that one person who has PTSD is following may differ from another. Your doctor will work with you to determine what is the best approach for your unique needs.

Jackson, MS - Out of Control Roller Coaster Injures 16 at Six Flags Amusement Park

Jackson, MS (August 27, 2022) - At least 16 people sustained varying degrees of injury, most non-critical, when a roller coaster jerked forward at Six Flags Amusement Park in Jackson.

According to local police and eyewitnesses, the high-speed, wooden roller coaster known as El Toro Roller lurched forward as riders were offloading at about 7:00 p.m.

Some victims received treatment on the scene while at least six were transported by paramedics to Centra State Medical Center in Freehold.

Our thoughts are with the injured victims and their families at this time. We hope for their full recovery.

Amusement Park Injuries in Mississippi

Jackson, MS - Out of Control Roller Coaster Injures 16 at Six Flags Amusement Park

More than 300 million people visit amusement parks every year, where the probability of being injured is about one in 9 million. Although this makes it extremely likely you can enjoy your day injury-free, the potential for significant and even fatal injuries is still present.

When someone is injured at an amusement park, they might be eligible to collect compensation for their damages via a personal injury lawsuit.  In order for the venue to be held responsible, victims must prove the park was negligent and caused or failed to correct the hazardous condition that caused the injury.

Some common negligence issues found at amusement parks include:

  • Malfunctioning or defective rides
  • Improper ride maintenance
  • Faulty safety restraints/Safety restraint failure
  • Dangerous or restricted areas that are ungated or unlocked
  • Insufficient warning signs around restricted areas
  • Insufficient ride warnings, like those that indicate people with heart problems should not embark
  • Poorly trained ride operators
  • Intoxicated ride operators
  • Slippery surfaces with no warning signs
  • Poorly maintained grounds and buildings

If the actions of a park employee caused your injuries, the park will typically be held liable. Amusement parks are typically responsible for the behavior of their employees, so, for example, if an employee neglected to inspect a safety harness, then the park will be held accountable.

Due to the extensive amount of work involved, determining whether suing for this type of injury is advisable should be decided by a qualified Mississippi premises liability lawyer.

Pedestrian Accidents in Mississippi

Meridian, MS - Injuries, Property Damage Ensue When Driver Crashes Through College Park Bank

Mississippi law says that drivers have a duty to operate their motor vehicles safely, especially in an area with pedestrians. Sadly, this is not always what happens. Contrary to widespread beliefs, pedestrian accidents are not automatically the pedestrian's fault. Often, they are the result of driver negligence.

The most common types of Mississippi driver negligence include:

  • Failing to yield the right of way while turning
  • Failing to stop at a traffic light or stop sign
  • Driving while distracted/Not paying attention to their surroundings
  • Not paying attention when driving through a crosswalk
  • Driving while intoxicated

Pedestrians are not always aware that walking along a roadside, even a slow one in their own neighborhood can be dangerous. They expect the drivers of cars, trucks, and other vehicles to follow the law and behave responsibly. When issues such as distractions or poor visibility become part of the scenario, innocent pedestrians can quickly become accident victims, often sustaining catastrophic or fatal injuries in the process.

Although a collision between two vehicles doesn’t always result in injuries, accidents between a vehicle and a pedestrian often do. Whether the involved vehicle is a pick-up truck, passenger sedan, oversized commercial vehicle, or a motorcycle, when they make contact with a pedestrian, it normally produces catastrophic injuries such as:

  • Multiple fractured and broken bones
  • Traumatic head injuries
  • Traumatic brain injuries
  • Spinal cord damage
  • Serious lacerations resulting in permanent disfigurement or scarring

A pedestrian accident lawyer in Mississippi can ensure that you receive a fair settlement for your damages.

If you sustained substantial injuries due to the negligence, dereliction, or malice of a second party, we are ready to assess your potential pedestrian injury claim. Contact our pedestrian injury lawyers in Mississippi by calling our firm at (601) 487-0555 to schedule a case evaluation.

Do Insurance Adjusters Have to Accept a Car Accident Police Report?

After an injury accident, such as a car crash, for example, there are several damages that a victim may suffer. Medical expenses for treatment of injuries, property damages to a vehicle, and more. All of the losses that a victim sustains can be identified and tabulated to get to some amount of financial compensation that is fair. A personal injury claim can be filed against the negligent party’s insurance provider to obtain that financial compensation.

To be successful with one’s claim, however, it is necessary to support your damages with evidence. Medical bills after being seen by a doctor for injuries or a car repair bill for the destruction that happened after an accident are just a couple of the possible types of evidence that can be used. Police reports too may also be helpful for showing that certain damages exist and happened as a result of a car accident.

Is it Required to Accept Police Report Findings After a Crash?

Do Insurance Adjusters Have to Accept a Car Accident Police ReportUnderstanding which pieces of evidence and documentation can be helpful to a personal injury claim is something that an attorney can advise you on. In Mississippi, Bob Germany is a Jackson car accident attorney who can identify all forms of evidence that can strengthen your claim and your position regarding the totality of your losses after an accident.

When 9-1-1 is called after a car accident and an officer comes to the scene, they will be assessing the situation to see if everyone is ok and if there were laws broken which caused the crash. They will speak to the parties involved and even witnesses if there are any. They will scan the accident and investigate how everything looks. In their report, they will include the identifying information of the parties they spoke with, the property damages that resulted, and the injuries that may have transpired. Potentially, they may include an explanation of how they believe the accident happened.

When you file a personal injury claim your attorney will get a copy of the Mississippi crash report to see if the findings can be advantageous to showing your damages and strengthening your claim. The insurance adjuster of the company you filed a claim against will also obtain a copy of the report to see what it says.

A police report is helpful to make a strong argument that certain damages were a direct result of a crash. An example would be certain injuries you suffered that the officer witnessed at the crash scene. When negotiating with the insurance company for a full settlement, these details in the report can be helpful to show your harm existed.

But insurance agents do not have to agree with everything in the report and may refute certain aspects. Who caused the accident is one area that the insurance adjuster may question and counter that you were also responsible for the crash. Your Jackson personal injury lawyer at Germany Law Firm, PLLC knows how to use the findings of a police report to show the damages you suffered and to leverage it for the most compensation possible.

Speak with a Mississippi Personal Injury Attorney Today

The police report can be a strong piece of evidence that is used to help you establish the damages you included in your claim. But, the insurance adjuster does not have to and may not agree with everything in it when settlement negotiations are taking place. It is important to have an experienced Jackson personal injury attorney that is skilled in these matters to secure the highest amount of compensation on your behalf.  To schedule a free consultation with the Jackson injury lawyer at the Germany Law Firm, PLLC, please call (601) 487-0555.

Fatal Car Accidents in Mississippi

Waynesboro, MS - Woman Killed, Man Hurt in Collision on Beat 4 Shubuta Rd

The figures tripled in 2019 to 1,579 serious injuries from automobile accidents, and then more than quadrupled again in 2020 to 3,6030 serious injuries from car accidents in Mississippi, according to reports. This significantly surpassed Mississippi's stated goal of 1,452.6 severe injuries from auto accidents for the next year.

The suffering that results from an unexpected loss of a loved one is indescribable. The anguish is compounded when one considers that another person's carelessness contributed to the unfortunate event. You might be wondering what the next step will be at this point.

We recognize that the prospect of filing a case for wrongful death may elicit a range of feelings inside you. We are also aware that no amount of money can ever bring back a lost loved one or make the anguish and loss that you are experiencing any more bearable. Unfortunately, the only remedy that the law may give in these types of cases is a monetary award against the person or corporation that is at blame for the death of your loved one in order to recompense you for your loss of that person.

Money will never make up for the death of a loved one completely. The Germany Law Firm PLLC is aware of the potential rise in expenses that might be brought on by an occurrence that was brought on by someone else's negligence. Call a Waynesboro wrongful death attorney at (601) 487-0555 if a member of your family suddenly perished in a vehicle accident to explore your legal options and how to go on with your life.

Mississippi High-Speed Collisions

Oxford, MS - At Least One Injured After Wreck on 18th St

Speeding is a prevalent factor involved in serious car accidents across the state. The National Highway Traffic Safety Administration conducted a five-year average and found that on average 76 persons die in Mississippi each year as a result of speeding. Aggressive driving, such as speeding, can cause automobile accidents in a variety of ways.

By working together with an attorney, you are taking preventative measures to safeguard the amount of compensation you get from being reduced or withheld by a third party. Your attorney will be at your side every step of the process, collaborating with you to ensure that the other party fully comprehends the extent to which the accident has impacted your life.

It is possible that the insurance company will try to blame you for the accident or argue that your injuries existed before to the incident. Either of these arguments has the potential to prohibit you from collecting the compensation that is stipulated in your contract. You do have one competitive advantage against these irresponsible insurance companies, and that is an experienced automobile accident lawyer. Despite the fact that this might be annoying, you do have this advantage.

The Germany Law Firm PLLC carefully evaluates all pertinent factors when determining compensation because we feel that leveraging all available legal resources on behalf of our clients is one of our most important jobs. If you have questions regarding how to go on with your life after sustaining injuries in an accident caused by another driver and want to learn more, call (601) 487-0555 to speak with an Oxford personal injury lawyer.

Distracted Driving Crashes in Mississippi

Oxford, MS - Bramlet Blvd Reported Site of Collision with Injuries

Paying attention behind the wheel is imperative, but unfortunately, many drivers fail to focus on the task at hand. In our state, distracted driving continues to be a major factor in auto accidents. According to the Mississippi Department of Health, one-third of adult drivers and three-quarters of mobile phone talkers confess to using their phones while operating a vehicle, respectively.

Regardless of the severity of the collision, any person who was engaged in a vehicle accident should seek medical assistance in the immediate aftermath of the incident. Sadly, this is typically a costly endeavor, and if you are not adequately compensated for your efforts, you may find yourself in a substantial amount of debt as a result. It is very possible that you will make a claim with your insurance company; nevertheless, for some inexplicable reason, the vast majority of insurance firms prefer to behave unethically when paying out claims for their customers.

Accident victims should consult with an Oxford car crash lawyer to safeguard their ability to sue for damages, exercise their legal rights, and submit a claim for compensation if they were hurt as a consequence of legal negligence. Top 2 Reasons Why You Could Be Liable for a Crash in Bad Weather

It is not ideal to be driving when the weather is inclement. This is because it typically becomes much harder to operate one’s automobile depending on what the weather conditions may be like. For instance, in heavy rain, seeing clearly is not going to be as easy as it is on a dry, sunny day. Or driving on icy roads will not be as safe as driving on dry roads. Weather makes a difference in driving and is a reason why many accidents happen when it is not so nice outside.

In some cases, a weather condition can exist where it can be hard to point to issues of negligence as a factor that caused the incident to happen. Other times, negligence may be a factor in an accident taking place. This is why after a car accident in Mississippi, you take your case to be evaluated by the Jackson car accident attorney at Germany Law Firm, PLLC. If you have a case that warrants a claim, Bob Germany, a Jackson personal injury attorney can help you with it.

When Can a Driver Be Liable for an Accident Happening in Bad Weather?

Top 2 Reasons Why You Could Be Liable for a Crash in Bad WeatherIf you were injured in a car accident, you may have a long road to recovery with many costly expenses on the horizon. It could be possible to recover your financial losses by filing a Mississippi personal injury claim. To learn more, the Jackson car accident lawyer at the Germany Law Firm, PLLC offers assistance.

Any of the following situations may lead to negligence in a car accident in bad weather:

  1. Drivers that do not adjust their driving to account for the conditions. It is expected that when the weather is bad, drivers leave enough room, drive slower, and be more cautious with their actions for safety reasons. If they are tailgating in these conditions, they can be held responsible for a crash. Likewise, even if they were not driving very fast, if they were still driving faster than what would be reasonable for the conditions and a crash happens, this can show negligence existed on their part.
  2. A driver that does not keep their vehicle up to date with required maintenance and care can have one that is dangerous to others. A vehicle may be much more difficult to operate safely for a driver when parts are worn out and do not work as a result of the driver's lack of maintenance on their vehicle.

Speak with a Jackson Car Accident Attorney Today

Often when a crash happens, especially in bad weather it is the belief that it is always the weather and not a driver that causes these incidents. But this is not always the case. It can be beneficial to talk with the Jackson car accident lawyer at Germany Law Firm, PLLC after you were injured in a crash in Mississippi. You may be able to recover compensation for your losses.

Mississippi Car Crashes

Oxford, MS - Injuries Result from Collision on MS-6 near CR 405

According to the National Highway Transportation Safety Administration, there were 4.8 million accident victims and 38,000 fatal motor vehicle occurrences in 2020. The good news is that death rates have decreased over the previous 10 years, mostly as a consequence of improvements in healthcare and auto security.

Automobile accidents in Mississippi are far too common and frequently involve serious injuries, property damage, and even fatalities. Whether via insurance or a lawsuit for personal injury or wrongful death, a Mississippi car accident attorney may assist clients in obtaining financial recompense for their losses following a vehicle accident.

The Germany Law Firm PLLC has experience working with this organization and can assist accident victims in receiving just compensation for their suffering.
